Terms and Conditions

Before you start reading the endless information below, just want to start off this page by informing you of a simple fact of mine – this is what I do for a living. I love doing art and for certain medical reason, i use art to make a living. If I could do this for free, I would, but sadly the world runs on bills and they have to be paid.

Adopts/Original Character Sales

  • Serious buyers only and only if you have the full amount available
  • Holds only apply to Auto Buy Adopts and valid for 7 days – after that time period, it will be automatically put back on sale
  • Payment is required within 24 hours of winning the adopt unless AB’d – failure to make payment or hiding your bids will result in being blacklisted and not allowed to make future purchases. In case of a charge back, you will be placed on an immediate blacklist as well as reported to PayPal and other artists with your email address used on paypal.
  • All pricing for all Adopts, Commissions and alike is in USD / United States Dollar – unless bought with DeviantArt Points – conversion for dA points $1.00 USD = 100 points
  • Please credit me or link back to my account whenever you upload or use the adopt – feel free to use any of the following links for credit:
  • Until I confirm to you with your adopt file that I have received your payment in full, you are NOT allowed to use the adopt in any shape or form. This means you are NOT allowed to use, trace, reference, redistribute, copy, or sell the adopt anywhere
  • After confirmation and payment received, your file will be delivered to you as a PNG with a transparent background
  • Once paid in full and you have received the file, you are free to do anything you want with your new adopt (this excludes Original Species designs). What does that mean:
    • you can change/alter the colors, race, gender, design, other
    • unless specified you may resell at higher or lower cost
  • Open or Closed species designs bought from me cannot be altered unless the species specifies you are allowed or you made arrangements with that species owner
  • HQ Adopts if exceeding $100.00 USD can have payment plans arranged for if arranged with me in advance – adopt will not be released until payment has been paid in full Due to people abusing this and payments are late, payment plans are no longer available. If full payment isnt available at the time the adopt is bought, the sale will be cancelled
  • Work files of adopts are normally kept for 1 year before i delete the original work file. If the image is lost after that period, sadly I can not assist you with returning the file to you
  • Auctions that has been available for 7 days with 0 bids will be set over to another payment option (OTA, Set Price, Raffle, DTA, WTA) depending on what kind adopt it is.
  • NO REFUNDS ONCE PAYMENT HAS BEEN RECEIVED.
  • In case of payment problems, the adopt will go back on sale – this includes charge backs, partial payment and alike. If a charge back is ever issued, you will immediately lose the adopt as well as all species I work with, as well as myself, will be notified that you filed a charge back and be placed on the black list.
  • I reserve the rights to being the artist/creator to use the art piece as part of my portfolio and marketing with credit to you as the owner.
  • By purchasing one of my adopts, you agree you have read, understand and agree to all of the information above given to you.

Commissions Ordering and Sales

  • Please never rush me on any project – lead times are below along with more information about where to see your goodies. Rushing leads me to hate a project which results in crap work.
  • All progress on my projects are recorded on Trello – Be sure to see my Trello first before contacting me to see how your project is progressing
  • Characters / projects with bad references or half completed references will not be accepted (example if you want a full body character drawn but the only reference you have available for me is a bust image)
  • Copyrighted images/media/ip’s will not be used by me for monetary purposes – this means that if you come to me and ask me to draw you a PKMN that you would like to use for printing t-shirts with, I will refuse your project.
  • I am allowed to refuse any commission at any stage. If I do, I will give you the reason why and refund you if the project if still in the rough/draft stage.
  • All prices are an min required for the project to start as well as an estimate cost. Additional fees will be added depending on the complexity of the project at hand and quoted to you before hand if there is a difference in pricing if it applies.
  • Cancellations of projects before its reached 25% progress and without proper reason will result in a work free to be deducted before payment is refunded, depending on the progress of your project. (example – if im 20% into the project, a 15% fee will be applied and the remainder will be refunded to you – 20%+15% = 35% is what im keeping for work completed and your refund will be 65% of the total cost and cancelling because you stubbed your toe will result in 0% refund)
  • No refund will be issued once a project has reached 25%+ progress
  • Please note that the following priority is applied in terms of work focus
    • My day job + Patreon > Commissions + Adopt work > Other
  • All art will take a minimum of 30 days to complete but should not exceed 120 days unless there is special circumstance applied (me having trouble drawing certain parts of the project, loadshedding issues by my country or other physical or equipment problems) If you feel after 30 days that you would like a personal update on your commission, feel free to let me know on any of my social sites:
  • Customs could take additional time to the above as I tend to flesh them out better than already pre-made works
  • YCH and alike projects fall under the same ToS as Commissions
  • After purchase and delivery, you are allowed to use as you wish – reupload anywhere, resave, edit, alter, resell, etc. as long as you credit me in some form for the art that I have made – feel free to use any of the social links above for credit purposes
  • In case of payment problems or charge backs, the commission(s) will be immediately cancelled my end. In case of a charge back, you will be placed on an immediate blacklist as well as reported to PayPal and other artists with your email address used on paypal.
  • NO PROJECT WILL BE STARTED WITHOUT FULL UPFRONT PAYMENT FIRST.
  • If a commission / custom adopt is delivered (wip or completed) to you and I get no response from you within 7 days of that delivery – I will assume that the project is done correctly and be completed as per the wip, or mark as completed if its the final art piece.
  • I reserve the rights to being the artist/creator to use the art piece as part of my portfolio and marketing with credit to you as the owner.

Graphic Design Projects

Vector Art

  • Simple vector art, logos and alike leadtime is 3 days.
  • More intricate/complex art can take up to 7 days

WordPress Websites

  • Before we can start, the following needs to be ready
    • Own URL and Web Hosting (I do not handle these anymore but can assist on acquiring these if you do not have one yet)
    • Pages required with their bodycopy/writing and images
    • Logos and other assets that has to go on the site
    • Limited to a Home Page, About, Services/Items and Contact page – any additional pages will cost extra
  • I merely do the layout of the website and make it ready for use.
  • WordPress maintenance has the following included:
    • Security checks – making sure all of your plugins and data is updated
    • Adding on of blogs, content and alike (if you want to add any additional data like extra images and pages, that will incur extra costs)
    • Handling of minor problems that occurs

Manga/Comic Pages cleanups

  • Depending if its vector or illustration will determine the deadlines
  • Heavy intricate pages might incur extra costs but these will be quoted on beforehand
  • Large scale orders (20+ pages) are available on special pricing

General Graphic Design

  • Leadtime on projects can be anything from 3 days to 7 days depending on my availability
  • Basic outline brief is required before the project starts

Vector Assets

  • Flow chart assets are mostly just the extra little graphical bits (like a pie chart, or person sitting at a desk) that can be added onto your presentation. Compiling of the presentation itself is an extra cost in the software of your choice.
  • Emoticon pages are catered to each person from the base up – and variation from the standard set (the ones you can find on your phone) and extras are available at extra cost.
  • I reserve the rights to being the artist/creator to use the art piece as part of my portfolio and marketing with credit to you as the owner.

OTA Trades

For You

  • Please note my priority of work will always be – My day job + Patreon > Commissions + Adopt work > Other –  OTA work falls under OTHER
  • All progress is recorded on my Trello – be sure to check there before contacting me
  • Commission ToS apply unless otherwise stated here
  • After art is completed, I will let you know where you can download the hi-res version of your file
  • Minor changes are allowed as long as the reference images given to me were complete
  • Samples are given when I make the offer so please expect the same quality as a minimum when I submit to you your art.
  • I reserve the rights to being the artist/creator to use the art piece as part of my portfolio and marketing with credit to you as the owner.

For Me

  • Characters I want you to draw is always located on my tH – feel free to pick any of them in any of those folders and go crazy
  • Art delivery has the time lead time as I have – 3-4 months max is what im willing to wait depending on the quality of your work
  • I prefer QUALITY over quantity
  • Art to meet the same quality as the adopt or art that is being traded as a minimum guide line
  • Once the art has been delivered and I am happy, you will be pm’d or tH delivered your adopt
  • I RESERVE THE RIGHT TO DENY THE TRADE AT ANY STAGE – normally before accepting art I go through your gallery and chose characters I think is best suited to your style and skill. I wont lightly refuse the deal but if I see you did not try your best with the art, I will refuse the trade in the end. I have been a designer, illustrator and artists for many a year (keep in mind, my RL age is in the 40’s) and can see when someone worked hard or not. Keep in mind I see ART as CURRENCY when making trades.
